It seems that Brock Lesnar's attorneys are hoping to finally put an end to the saga of his UFC 200 bout with Mark Hunt. As has been highly publicized, 'The Super Samoan' filed a lawsuit against the UFC, Dana White and Lesnar himself after their now infamous bout last July due to the former UFC Heavyweight Champion's post-fight drug test failure. Lesnar tested positive for banned estrogen blocker clomiphene both before as well as actually on fight night. The test results infuriated Hunt who seemed speculative of the drug testing beforehand anyway and he quickly responded by demanding huge financial compensation. Once that was declined, the lawsuit was filed.
Brock Lesnar’s legal team has now officially responded with some strong words in response though and MMAjunkie reports that they have filed a motion to dismiss the lawsuit. In a thirty-page retort, Lesnar's lawyer argues that Hunt is trying “to convert a positive test for trace amounts of a banned substance…into a scheming RICO claim,” as well as saying that the suit "fails miserably, float(ing) on a sea of bombast". The response not only wants the suit to be dismissed but also the removal of any option to re-file, claiming “Plaintiff’s complaint is so devoid of any facts to support his RICO and fraud claims that it would be almost impossible for Mr. Lesnar to respond.”
“Plaintiff’s RICO claim is so incredibly deficient as to defendant Lesnar, that it is difficult to know where to even begin. As an initial matter, plaintiff lacks standing to bring this claim, because he does not even allege the type of injury that is covered by the RICO statute," the motion states. "Furthermore, as to defendant Lesnar, the complaint fails to plead long-term criminal activity, fails to plead a predicate act, fails to adequately plead intent, fails to adequately plead fraud, fails to adequately plead false pretenses, fails to adequately plead the requisite pattern of activity, and fails to adequately plead a conspiracy within the meaning of the RICO statute.”
Though many seem to sympathize with Hunt's situation, it's obviously very unclear as to whether or not he'll be able to get the financial compensation he desires. As well as Lesnar, Dana White and the UFC also filed a motion to dismiss the lawsuit. The motions are expected to be heard in a hearing on May 15th.
